Terms of Service

These Terms of Service ("Terms") govern your use of the Noesis Library mobile application (the "App"), operated by Noesis Performance ("we", "our", or "us"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

The App is intended for a general professional fitness and coaching audience. You must be at least 13 years old to create an account and use the App. The App Store age rating reflects content maturity and may differ from this account requirement.

2. Your Account

You sign in using your Apple or Google account. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

3. Subscriptions and Billing

Certain features of the App require an active subscription ("Premium"). Subscriptions are offered on a monthly ($7.99/month) or annual ($79.99/year) basis, managed entirely by Apple through the App Store.

• Free trial. New users receive a 3-consecutive-day free trial. The trial begins on your first day of use and ends automatically after 3 days. You will not be charged during the trial period.
• Billing. After the trial, your selected subscription will be charged to your Apple ID at the confirmed purchase price. Subscriptions renew automatically unless cancelled.
• Cancellation. You may cancel at any time through your Apple ID account settings. You retain access until the end of the current billing period.
• Refunds. All refund requests are handled by Apple in accordance with their App Store Terms. We do not process refunds directly.
• Price changes. We reserve the right to change subscription pricing. Apple will notify you before changes take effect.

We do not receive or store your payment card details. All payment processing is handled by Apple.

4. Content in the App

Exercise Library, Equipment Library, Databases, Calculators, and all other reference content are created and maintained by our team for general informational and educational purposes. Videos and images are delivered via Bunny.net CDN infrastructure.

5. Feedback Submissions

By submitting feedback, you grant us a non-exclusive, perpetual license to use your suggestions for product improvement. Feedback is visible to our administrators. You may delete your own feedback at any time from within the App.

6. Personal Data Stored on Your Device

Features such as personal notes, favorites, hidden items, recently viewed history, and preferred exercise names store data locally on your device only. This data is not backed up to our servers and will be lost if you uninstall the App.

7. Informational Use Only — Not Medical Advice

Calculators, formulas, constants, and all other reference content are provided for general informational and educational purposes only. They are not medical advice. Consult a qualified professional before making any health, training, or medical decisions.

8. Acceptable Use

You agree not to: (a) misuse the App or attempt to disrupt its operation; (b) reverse engineer or extract source code, except as permitted by law; (c) use the App for any unlawful purpose; (d) circumvent subscription access controls.

9. Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the App and request account deletion at any time by contacting us.

10. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee the App will be uninterrupted, error-free, or that content is accurate, current, or complete.

11. Limitation of Liability

To the fullest extent permitted by law, Noesis Performance shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

12. Changes to These Terms

We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance of the revised Terms.
